Legal Question in Family Law in California

Terms for Annulment

I have 3 young children from a previous marriage. I re-married 1 1/2 years ago. After 6 months in my new marriage, my husband began physically abusing my children. Some of the incidents were reported to law enforcement and CPS. We are now looking to divorce because of it and I was wondering if abuse to a child that isn't biologically yours would be an acceptable case for an annulment.

No, unless he married you with the intent to abuse the children and told you that he wouldn't. Good Luck, Pat McCrary

Re: Terms for Annulment

No. You can only seek an anullment based on force, fraud, physical incapacity, unsound mind, minority-not 18, or because of marital status as all these items relate to you and your spouse. You will have to seek a normal dissolution of marriage, divorce, to end things with him. Good luck to you-Martin.
