Terms of Divorce

My wife and I are divorcing(June 30).She has moved from SanDiego to Denver to live with her boyfriend.Our divorce papers state that the spousal support would stop if she gets married or cohabitates.How long does she have to live with him before it is considered cohabitation by the corts in california.What proof would I need?

It depends upon the specific language of your judgment. I have handled three appeals on this issue over the last year and can tell you that it is a complex area of law. If she left California to live with the boyfreind I would state that is fairly conclusive that she is co-habiting. The more proof you have the better your case.
