testify/tape recording

1. Can children ages 16 and 17 testify on their behalf against their father regarding visitation ?

2. Am I allowed to use a taped phone conversation in court ?

Re: testify/tape recording

Unless there is a court order allowing recording conversations you cannot the tape recording. Recording a conversation without the consent of all other parties is a crime and carries a$500 minimum penalty. As to the childen testifying, that would be up to the judge. The reality is that children that age cannot be forced to visit the other parent. Do not however, encourage them to not visit their father.
