Legal Question in Family Law in California
text messages and myspace entries as evidence
Can a father use text messages and myspace entries as evidence in a divorce and custody case? If so how do you prepare it for submission and are there any rules about what can and cannot be used?

Re: text messages and myspace entries as evidence
That can be used as evidence. Evidence in court is a very complicated issue. It may be used as evidence if the father authenticates that those are indeed copies of things that were sent via myspace and text. If he denies it, then you will have a hard time proving it.
As always please consult with a local attorney in your area before making legal decisions.
Good luck!
