Legal Question in Family Law in California
I am thinking on getting a divorce and I would like how it would affect me financially. I have been married for 15 yrs. my husband is an alcoholic and I have medical records to probe it. We have 3 boys ages 9, 11 and 5. My husband recently got fired from his job because of bad temper towards his boss. he has no job, just collects unemployment. I am a RN. and a decent job.since we got married we have had separate bank accounts, he has no money and I have some savings. we bought a house 7 mos ago. I would like to keep the house since we still have 30 yrs of payments. I can afford the payments on my own. I am willling to give him 50% of the down payment we put down. can that be done??
He has been very irresponsible when it comes to the kids. He has been diagnosed with depression and failed alcohol treatments. My oldest son had to call 911 once because he was so drunk my son thought he was having a heart attack. they want to stay with me. He has a credit card where he owes $4.000 is not on my name. he has been late on payments in the past and I also want to know if that is my responsibility too??
we don't own anything else, just the furniture in the house, nothing too special.
what do you think of my case.

All the money you earned during the marriage is community property. The house probably has equity that it equal to or less than the down payment. Your major problem will the be spousal support. You can have the court order him to seek employment.
Your financial exposure is considerable. Seeking the advise of an attorney to represent you and advise you regarding they options would be the best advice you will receive.
