Legal Question in Family Law in California

Thinks the court order is a joke/contempt

I filed contempt charges on my ex wife for violation of a court ordered visitation. Since I have served her with the contempt paper work she has violatied again and has now canceled all visitation(supervised). I contacted the child abduction unit and they contacted her and she said she would schedule the visitation, she did and then canceled 4 days later again.(she was just Passifing the child abduction unit officer)Can I amend my contempt? If so what form or how? If not can I file 2 contempt cases on her? I dont know what to do? Please help she thinks this is a joke and she can do what she wants.

Yes, you may be able to amend the contempt, but why? The additional information may be used at sentencing or you may file a new contempt action. Contempt is quasi-criminal, it is very technical in nature and it is difficult for most family law attorneys to get a conviction. It is highly unlikely that you will be able to pull that off. Further, there may be easier ways to accomplish what you are trying to do. Get the advice of a good family law attorney. Good Luck, Pat McCrary

You can file an additional contempt citation for additional acts of contempt that are not alleged in your prior contempt citation.

Contempt of court is a complex area of the law. I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
