Legal Question in Family Law in California

Time away from the children

My criminal case was reversed and I was aquitted of all charges after a five year prison sentence. My twin sons were 2yrs old when I last seen them, they are now 8 yrs old. I have aquired direct proof of my innocence and I am currently seeking full custody of the twins. My legal argument is she lied about the domestic violence in order to interfer, deny lawful contact and destroy the father child relationship.

q. Can family law court deny me full custody of my son's base on my five year prison sentence.

Re: Time away from the children

The lack of contact with your sons is a factor that the court will consider. The fact that you were not at fault will also be considered. The first step would be to get contact with your sons and start the reunification process.
