Legal Question in Family Law in California

Timely divorce

My lawyer submited my divorce to the file clerks office

over 2 years ago. Proof of service is missing. I have

called the clerks office many times asking for updates.

There are none. My lawyer won't return my phone calls.

I don't know how to do the proof of service myself or I

would. Is there some sort of advocate I can contact, I

don't have enough money for another lawyer.

Re: Timely divorce

You could contact the California state Bar and report this probolem, and send a copy of the complaint to the attorney. That should get his attention.

To file a proof of service would require finding the individual that served the summons and petition. Then that person would have to sign a statement under the penalty of perjury setting forth the date, time and place of the service.
