Legal Question in Family Law in California

I have been told that giving legal advice over the phone is illegal. I would like to provide consultation to families and individuals involved in the Family Court and child support system for a fee. I would not give them legal advice because I am not an attorney but, I would like to refer them to one I trust.

What are the legal ramifications of providing advice for a fee to the public?

There is nothing illegal about giving legal advice over the phone unless you are not a lawyer. So for you it would be illegal, but not for me. There are no legal ramifications of providing advice for a fee, as long as the advice you are giving does not require some form of professional license. You can't give legal advice, medical advice, legal advice, etc. You are perfectly free, however, to give non-professional advice. With that said, however, I find it very hard to think of any advice you could possibly give someone involved in Family Court and child support issues that would be worth any payment that would not constitute the illegal practice of law. Considering the Family Law Facilitator in your county, and the Judicial Council provide a great deal of free information, and even provide attorneys to answer simple legal questions free of charge, anything that you might add that would be worth charging anything is almost certain to be illegal providing of legal advice.
