Legal Question in Family Law in California

Transfer of Property to Family Member

In 2000 my great aunt was diagnosed with ''mild dementia/probable alzheimer's. In March 2002 she decided to take care of some personal matters and in that, she transfered her home to a niece (by marriage) because she wanted to for various reasons. The brothers & sisters just found this out four months ago and are not happy. They say that she left the house to them in her will. She is still living as of now. Is the transfer of the home still legal considering her diagnosis?

Re: Transfer of Property to Family Member

There is not simple answer to your question. The validity or lack of validity of the transfer is dependent upon the facts of your case. The degree of her dementia, and the relationship between her and the niece by marriage.
