Legal Question in Family Law in California

Transportation of minor child over state lines

I will be traveling to another state with a minor. The child is not my relative and I do not have legal custody of her, but I do have the permission of her mother. The duration of the trip will be 3 to 4 days. Do I need written documentation regarding the mothers permission, or any other proof that I have permission to travel across state lines with the child? Do I need to notify any authorities?

In a word, yes!! You should get permission in writing, and have the mother sign a medical consent forum in case of emergencies. You do not need to notify any authorities, but by all means get written permission.

If the mother has sole custody of the child than you do not need to get any type of permission or notify and state agencies. If the father and mother have joint custody than the mother needs to notify the father in writing of what the travel plans are. If the father isn't in the picture or if they are still married and he is fine with it than all you need is a simple two or three sentence letter from the mother giving consent for medical treatment in case of an emergency. Have her sign it and include any and all numbers she can be reached at in case of an emergency so that they can make all attempts to reach her. Otherwise, have fun!
