Legal Question in Family Law in California
I have a trial date scheduled and I don't have an attorney. The opposing party however does have an attorney and I am trying to get him to change the trial date because I am not going to get all of the documents needed for trial before that date. Is her attorney the only person that can change the trial date? Can I call the court or file a motion to change the trial date myself or do I have to have her attorneys approval first?
Help please, I cannot get her attorney to budge on anything and the communication is awful. All her attorney does is write back really rude and unprofessional comments and I don't know what to do.
Thank you

You could file a motion requesting a continuance. You may have to request an order shortening time for the hearing and service of the moving papers.
Mr. Johnson is correct, changing a trial date is called a "continuance." Obtaining a continuance requires you to file a motion with the court following all the procedures for a motion with notice to the other party.
