Legal Question in Family Law in California

is it true that you need 2 lawyers (one for each side) to have a valid post-nuptual agreement? If both parties agree to the terms before going to see the lawyers(s) how much does it generally cost? I know that online legal forms are not useful in these situations, but if start by using an online form, would it save money when we go see a real lawyer.

Thanks,

michael in San Jose, CA.

No attorney with good consciences will represent two parties in such a case. You are asking for troubles. However, to save money, you can always write up whatever you agree to and then ask an attorney to review the document for you. It is not a double representation but a limited scope representation.

I urge you to consider the consequences of not carefully constructing a prenuptial agreement without the benefit of proper legal representation for both parties. I have 35 years of experience in this field and have set aside a number of these agreements due to poor construction. Please feel free to meet with me in an office consultation in my San Ramon office for no cost 925-743-8666. Arlene
