Legal Question in Family Law in California

Trust assets during divorce

I own 25% of an estate ( real estate) my brother owns 25%, and my mother owns 50%. This is all in a Trust set up by my parents. My father has passed. When my mother passes the Estate goes to the two Trustees, me and my brother. My wife may divorce me. If she divorces me, is she intitled to half of the Estate I will inherit, even though she is not listed as a Trustee? We have been married 30 years, but we have no assests other than my future Trust inheritance.

Re: Trust assets during divorce

An inheritance is separate property. Unless you add her name to your interest it should remain separate property.
