Legal Question in Family Law in California

trust fund siphoning from child (divorce)

My wife is the trustee for my child's trust fund account which he received in a settlement due to kidney failure. She has been siphoning money from this account for her personal benefit. We are currently in our first stages of divorce. I was wondering if there is way to remove her as trustee because in her mind she is planning to receive child support ,alimony and keep the trust for herself. My child is only four years old and could need a transplant anytime soon and will not have enough funds. Also could the judge handling our divorce see this as something negative on her? Stressed out parent!!! HELP!!!

You need to have her removed as trustee. At the very least, request an order for her to do an accounting. Then, if the amount of money that should be in there isn't there, ask to have her removed.
