WHat if you turn yourself in before charges are filed?

How long can a person be held in jail on domestic violence report before charges are filed in california?

The police will not take you into custody unless there is a warrant for your arrest or there is probable cause to believe you have committed a crime. Going to the police to turn yourself in would be considered a confession. The p[olice will ask you many questions regarding the incident. Talking to the police is the surest way to get yourself convicted. If you are that concerned about what is happening retain an attorney to advise you in this matter.

Generally, a person that is arrested will be arraigned i.e. asked to plead guilty or not guilty to filed cahrges within two to three days of his arrest. Any longer than that without having charges filed against the person typically violates constitutional rights.

If charges have not been filed against you, then there is nothing for which to turn yourself in.

If there was a police report for domestic violence filed against you, you can always hire an attorney before charges are filed to help protect your rights.
