How to Ubtain the Custody of a child.

I have a 12-year old daughter. I was not married to the father. A few years ago, I filed for child support through the district attorney's office. I need to have her custody in order to leave the country or get a passport. Can this be done with just a form, or will i need an attorney? I don't know how he will respond, if he will cooperate or ignore the entire thing. What would be my position in any of these situations? Please advise me, thank you.

Your local facilitators office may be able to help you prepare the motion in order to get a custody order. Since you do not know how he will react, you may need to get an attorney. On the other hand you may just ask him if he will stipulate to a custody order. It is probably best to get a consultation with a family law attorney so that you can discuss your options.
