Legal Question in Family Law in California
unclear judgement
in 2007 the father of my toddler and
I went to an OSC with both our
lawyers and signed a documents
saying we had the mediators notes
serve as court order (no appearance
before the judge) on of the
statements was for the non-custodial
parent to see the child every day and
every weekend. In 2008 we went
back to court to have some of those
custody issues modified. We showed
before the judge and he gave a
judgement which stated that the
non-custodial parent would see the
child every other weekend - that's it -
what is the court order to follow? the
2007 OSC or the judgement of
2008?

Re: unclear judgement
I would appear that the judge amended the court order at the 2008 hearing. The latest court order should prevail. You should have both orders reviewed by an attorney to get a more definite opinion. Good Luck, Pat McCrary

You should consult your attorney as he is most familiar with your case.
