Legal Question in Family Law in California

Uncollected Child Support

Ex husband owes back child support for 35 years, he is in

prison on a three counts and your out. When arrested they

confiscated X amount of money and it is sitting in the

general acct. at the police dept. I spoke with an attorney

almost a year ago, he said he could get some money for me

and would do it on a contingency basis but has not done

anything after dozens of phone calls. My question is is

there any way that I can file the papers on my own with

the courts to collect this money or do I have to go through

an attorney. Thank you.

Re: Uncollected Child Support

Did you have a written retainer agreement with this attorney? You may have a claim against him for malpractice. In any event, please report him to the State Bar of California. You can get the attorney complaint telephone number from www.calbar.ca.gov .

You can do it yourself, but it may be difficult. Find another attorney. Good Luck, Pat McCrary
