Legal Question in Family Law in California

Uncontested Divorce

My partner and I will file an uncontested divorce, contesting absolutely nothing, does the schedule of assets need to be filled out anyways? Does that form refer to assets acquired during the marriage? If so, there was nothing at all acquired during marriage.

Re: Uncontested Divorce

You must do a declaration of disclosure. That form does not need to be filed with the court if you have a written agreement dividing assets and liabilities and dealing with support issues. A schedule of assets and debts must me included with the declaration of disclosure. That schedule of assets and debts must include all property that you have an ownership interest in, including community proprty and separate property (non-community assets.) It must also include an income and expense declaration. Good Luck, Pat McCrary
