Legal Question in Family Law in California

Uncontested Divorce

My wife and I want to obtain an uncontested divorce. There's property involved (home and a couple of cars). We've agreed to separate this on our own. My question is if I file and she simply does not respond within the 30 days, will our divorce be granted without any complications?

Re: Uncontested Divorce

Not exactly. Nothing just happens, you have to make it happen. If there are issues, here property, and you have an agreement, you file the petition, the two of you sign a stipulation for judgment -- having your wife's signature notarized -- then you file a default judgment package, which requires a number of documents to comply with all the formalities. Then, yes, your divorce will be granted without complication.

It's a question of doing the paperwork correctly.
