Legal Question in Family Law in California

Unemployed Spouse

After 9 years teaching at a San Diego High School, my husband had an altercation with the principal and was placed on paid leave for about 2 years. His case settled last October, he resigned and has been unemployed since. He maxed out on Unemployment and has no income. When I divorce him is he entitled to spousal support from me?

Re: Unemployed Spouse

That depends on why he has not gotten a job in over 2 years. The court may impute to him an ability to earn, in which case he may get no support. Good Luck, Pat McCrary
