Legal Question in Family Law in California

Under the Uniform Act, Family Court Jurisdiction

I moved to Oregon in June 1999, and I would like to know if the State of California has jurisdiction over the court case that was first initiated in California. I have been told by my previous attorney in California, that after I have lived in Oregon with my daughter for 6 months, California no longer has jurisdiction over the case. Is this true, and if so, do I have to follow abide by the previous court order?

Re: Under the Uniform Act, Family Court Jurisdiction

You must abide by the previous court order unless/until it's changed. You may want to file a copy of it with your local Oregon court so that Oregon can take jurisdiction over the case instead of California. Your lawyer's right--Oregon has jurisdiction over your child now that she's lived in Oregon for 6 months (unless you kidnapped her, of course!) but it's up to you to register your California orders in Oregon in order to formally establish jurisdiction there. Unless your lawyer has given you a reason why it would not be advantageous to do so, you should probably register your CA orders in Oregon ASAP.

Good luck!
