Legal Question in Family Law in California

I am an unmarried woman in California, looking to have sole custody of my daughter. The father doesn't pay child support and only has a DNA test to prove he is the father. And only my name is on the birth certificate and every thing regarding the child, with the child having my last name. Does he have rights in regard to visitation and custody? Or do I already have sole custody?

He can file a Petition to Establish Paternity in order to get court ordered visitation. If you do not have court orders, then there are no custody orders. If he wants to try to visit or get custody, usually law enforcement will only get involved if there are court orders.
