Legal Question in Family Law in California

Unpaid Spousal support / alimony

I have a court judgement for alimony which my ex-husband defaulted on. He stopped paying me the allocated percentage quite a few years ago and stopped paying completely, 2 years ago. I am in California and have done a little research, and it seems I can only sue him for the past 2 years. I want to do this, and also make him re-start his payments. He is in a high paying job, whilst I am unemployed with no assets or savings. I do know who he works for, so I want to get a wage garnishment. I cannot afford an attorney so I am going to go through the process representing myself. I need to know what forms I will need to fill out,to get the process going. I would appreciate this information. Thank you.

You should consult an attorney to collect on the arrears and take him back to court to get a court order for the unpaid support and interest.

A family law clinic may be of help to self represented individuals. They are located at the local court house.

As always please consult with an attorney in your area prior to making any legal decisions.

Good Luck!

Re: Unpaid Spousal support / alimony

File a contempt action against him. Try to find an attorney since you will have the burden of proof.

If you prevail or reach a settlement, you should be able to recover attorneys fees.
