Legal Question in Family Law in California
Unprooved debt request
Went to court again for child support, during mediation ''mom'' finds out that she now needs to pay C.S., she brings up $3000 in medical bills that are unpaid for child. An agreement was made that her C.S. payments would go directly to this debt to pay it off. She has yet to prove the debt and 3 mths. have gone by. Is there a way we can get this judgement reversed and have her start paying the C.S. owed or will the court make us pay the $300 no matter what now? Sinceraly, Exhausted step-mom(:

Re: Unprooved debt request
It depends on how the order or judgment is worded. If it says you pay $3,000, then it is a judgment. If it just says you pay one half of the bills, then you need to file a motion to set child support payments and change the current order. Have the order reviewed by a family law attorney or the facilitator so that you can proceed properly. Good Luck, Pat McCrary
