Legal Question in Family Law in California

Un-Wed mother seeking cusody

I have been living with the father of my one year old child for 1 1/2 years. We never married. He has a child from a previous marriage in which he is to pay child support. He does so infrequently. He has not maintained work the full time we have been together and has horrible credit.

I am getting ready to relocate 500 miles away (still in CA.) without him to build a better life for my child. I want to gain full custody of my child and do not want him alter this if he decides to start working. I do welcome him to reasonable visitation rights. I am sure that I can manage to get by without his financial support. Is best for me to ask for full custody and include child support? My guess is that he could not pay. Would his lack of doing so make it easier to guarantee permanent custody and help him to lower his existing child support that is exceptionally high?

Thank you for your time.

Sincerely,

Re: Un-Wed mother seeking cusody

you should ask for child support. whether he pays has no effect on custody but will lower his other support payments.
