Legal Question in Family Law in California
Vacation
We are going to mexico in July. I will be taking my three children and my boyfriend will be taking his son. My boyfriend called his ex (his sons mother) and told her we would be taken the son to mexico for vacation. She had no problem with it and said she was ok with that. We told her we would be by the next day so she can sign a paper saying she approves us taken him to mexico. Well ... this is where the problem starts ... she does not answer her door (we know she's there because her car is there and the lights are on) she will not answer her phone. We went to her work and they tell us she's not there ... We already bought the tickets for the trip. What I want to know is: What forms do I need to file a motion againts her? I went online but there are so many forms on there that I'm not sure what forms to use. HELP! **and the question about abduction is not an issue. We have purchased round trip airfare, I'm taking my children, and we went last year** Thanks!!!

Re: Vacation
You should retain an attorney to obtain an exparte order, either to take the vacation or set the matter for a hearing on short notice and timing.
