Legal Question in Family Law in California

Vehicle loan

My divorce was final 1 year ago. The vehicle agreement in the final divorce was that the ex-wife would keep the new minivan and pay for it and I would keep my old truck and pay for it. I gave her everything the house and all it's contents. I left with my truck and a few clothes. She let the van get repossesed. I was ordered to pay her $1k towards the van loan. She never gave it to the finance co. Now there is a balance of $9k and the finance co. is after me to pay it. Do I have to?

Re: Vehicle loan

Your name was on the finance contract and the contract was breached when the payments were not made. The divorce court cannot let you out of the contract. Depending upon the terms of the judgement you may be able to go back to divorce court and get a court order for her to repay you. If the divorce court does not have jurisdicition over the matter then you can sue her in civil court and get a judgment against her and then record an abstract of judgment with the cournty in which the house is located with the county recorder.
