Legal Question in Family Law in California

Vehicle Ownership

Hello,

I was in a relationship for 8 years. We lived together 7 of these and had 2 children. We were not married. He claimed me on taxes and said that he would ''support'' me if I would stay home with the kids and help him with his business. I answered phones, took messages, etc. During our last year together, I needed a vehicle for myself, to get the kids around, etc. He purchased a used car for $4000, had both of our names put on the regisration, however I payed the registration, insurance, gas, repairs. I just came back from the DMV, trying to pay the registration that is soon due and I was informed that there was a transfer on the 16th and my name is now off the paperwork. What can I do about this? A few weeks ago, he stole some of my belogings and when I called the police, the said that there was nothing that could be done, because they were given as gifts to me, while we were together and therefore, were considered ''ours''. I need my car. Do I have any hope?

Thank you very much!

Re: Vehicle Ownership

You should file a petition to establish paternity. This will allow you to get child support. You could also request a court order giving you exclusive use and possession of the vehicle. Then file a complaint regarding violation of your agreement, a Trovolta v. Marvin complaint. You may be able to prove your agreement, and collect a portion of the value of the property obtained during the marriage.
