Legal Question in Family Law in California

Verbal agreement legally binding?

I am presently going through a divorce and am wondering if verbal agreements, specifically my agreement with my wife, will hold up in court. Also, if one party denies the agreement, or parts of it, will it still be valid?

Here are the details - we agreed to a non-contested divorce and she agreed she would not seek a monetary judgment of any kind (including spousal support, etc) if I supported her son entirely (my stepson, I have no legal ties to him) and her partially. I have upheld my end of the agreement, providing support for one year at an estimated cost of $15000.

Additional info: Any possible award she could get has been estimated (by my lawyer) to be $12-14000. Marriage lasted one year, she is not on the house title, house was purchased 3 years prior to marriage, no other major items of consequence.

Re: Verbal agreement legally binding?

Why are you asking these questions on the internet when you have an attorney. This indicates a lack of confidence in your attorney. You need to sit down and have a heart to heart with this attorney about your concerns. If you do not regain confidence in your attorney consider retaining new counsel.
