Legal Question in Family Law in California
violation of stipulation
My ex took a financial settlement
from me and signed a stipulation
ordering her to get a place to live of
her own (she had been evicted
months and was living with various
relatives). The only reason I agreed
to drop the case is so that she'd do
this for our nine-year-old and give
him some stability. SHe basically took
the money and spent it on other
things and still has no place to live.
My current spouse is outraged that
my ex didn't follow through on the
agreement. The question is: What
recourse do we have now? I
obviously need to bring it back before
the LA Superior Court judge, but how
exactly do I do that? What form I
need to file to get on the court
schedule? Help! My kid is homeless!

Re: violation of stipulation
File an OSC regarding custody, visitation and support. Ask the court to give you sole physical custody and the mother visitation (no overnights). You could file a contempt action, but you'll probably get better results with the custody/visitation modification.
