Visit My Daughter

I have a child with an ex girlfriend. Nothing has been filed with the courts. My daughter is turning 5 this October. I have seen her every day up until now. My ex has a new boyfriend, who refuses to allow me to see my daughter now. My ex is now going along with his request. Beside filing for custody, visitation etc, what else can I do? Could I walk up to their door and ask for her. Also, It has been 3 months since I last seen or heard from them. I call them and get hung up on. I just found out where they are living.

The answer to your question is too complex to be handled over the internet. Many questions must be

ask and answered before any advice can be given to you. There is not one answer to child custody matters as the standard is a "best interest of the child" standard which varies by child and by parents. You need to sit down with a family law attorney and go over the entire situation and he can give you some pretty good ideas about

what will happen. Almost certainly you will end up with substantial time with your daughter. Get an attorney because your child and you deserve the best possible result and this is going to set a pattern for child sharing for the next 13 years. Good Luck, Pat McCrary

It is important that you act immediately and go ex parte and request at a minimum temporary visitation. In this situation you may be granted custody if you would want her for a majority of time. The fact of refusal of access to your daughter weighs heavily in favor of your custody. Contact me directly 19 years experience.
