Legal Question in Family Law in California

Visitation hearing... alcoholic, drug abusing father.

I am separated from my husband, the father of my son. I kicked him out because of drug and alcohol abuse. I have filed for divorce. He is an alcoholic, and addict who didn't really care much to deal with him while we were together, and now he has filed a motion for visitation. The only reason I haven't let my husband visit him is because I am scared of my son's well being. A month ago he visited my son while in the care of my mother (I was working), and he was arrested in front of my son for having drug paraphenelia. The last visit he had was while I was at work again and he stopped by and had to be asked by the neighbors to leave because he was screaming at my mom while he was holding my son. My question is, he is asking to have unsupervised visits with him every weekend Friday-Sunday. He doesn't have a job, he hasn't given me a dime since October, he lives with his drug dealer girlfriend, he has been arrested twice since we separated in October, and has two open police reports, one for stealing from my mother, and one for assaulting his aunt and his cousin's dog... How worried should I be about them granting him unsupervised visits every weekend? Should I get a lawyer?

Re: Visitation hearing... alcoholic, drug abusing father.

Sounds like you should be requesting that he have supervised visitation with a professional monitor and go on alcohol and drug testing. We can have unsupervised visitation once he can show he's cleaned up his act -- if he does.
