Legal Question in Family Law in California
Visitation Changes
My husband has court ordered visitation to meet at a specific location on set days at a set time. Since I no longer live close by, I asked him if we could meet in the middle and he flat out said no. For the past 2 months, I've been driving 1.5 hours each way to drop them off and pick them up. I've filed a motion to change this, and we are set to go to court this week. However, he has sent emails stating that he won't be able to get the kids on the day of court (without mentioning court) because he'll be in southern California for medical testing. I haven't been told of any changes to our court date by the courts. I called this morning and they stated that we are still supposed to appear on Thursday. If he's a no show, will there be any changes to the visitation this week or will I still have to drive to get my children to their dad? Also, if he does show up, should I have the email in hand stating that he was unable to get the children that day, even though he showed up in court?

Re: Visitation Changes
You should go to court and explain the situation to the judge. You may be able to persuade the judge to modify the visitation location to accomodate where you live these days.
As always please consult with a local attorney prior to taking legal action. Good luck.
