Legal Question in Family Law in California

visitation modification

we have a current court order in place but between me & my childs mother we have signed a paper to modify the visitation to every other weekend. she is threatening me that if i deliver the baby late she can take away my weekend visits. i do all the transportation of our child pick him up & drop him off at her house. the reason i may be late would be trafic no other reason and it wouldnt be something in my control rather the natural rain causes delay. i know she can be controling and threatening. do you think the sheriff will say i can not take the baby if i arrive late and i have a signed paper by both of us stating we switch every other weekend?

Re: visitation modification

here is the written modification? Do you have the original? The safest thing would be to make this an order of court so that there is no issue. However, as long as you are within about 30 minutes of the exchange time, you should be okay. The police cannot take your visitation away. But they aren't always great about enforcing orders, let alone written agreements.

Good luck.
