Legal Question in Family Law in California

Visitation Non-compliance

When I asked my son's father where he's going to spend his visitation with our son this weekend, he said that he was going to take him back to the city where he resides.

Our court order does not allow visitation in the city where he resides.

How should I approach this situation when he comes to pick up our son?

Re: Visitation Non-compliance

Your response would depend upon the wording of the visitation order. Also the reason that the order prevents him from taking your son to that city would also have to be considered. If taking your son to that city presents a danger to him then you should resist visitation and immediately seek a temporary order stopping visitation. If the purpose of the order is to avoid contact with a person, the reason for avioiding that contact would have to be considered. The bottom line is does his contact place your son in danger, and it so how great is the danger.
