Visitation rights

Filed for divorce this year in May

Court date with mediator in August 2008. Soon to be Ex-spouse will not let me see my children, have not seen them since March 2008. Do

not know where they live nor a phone number. What rights do I have at this moment to see my children. Only contact with them if they call me.

You have the same rights the mother has. You may want to consider obtaining an ex parte court order before mediation to require the mother to give you custody or visitation of your children pending mediation. If you go into mediation without having seen or talked to your children in the last 5 months, the results will not be good.
