Legal Question in Family Law in California

visitation

My son's father has set visitation for every Tue. and Thurs, from 10am -6pm. He also is ordered to pay child support and was ordered to do a parenting class to be completed by 12/1/06. He does not do any of the court orders, and he has told me that he has full intentions of taking my son from me. Is there any way that i can get a court order saying that all his visitaion is to be at my home only?

IF HE FAILS TO COMPLY WITH COURT ORDERS YOU MAY BE BETTER OFF HAVING HIM DO VISITATION WITH A PROFESSIONAL SUPERVISOR. YOU MIGHT BE ABLE TO GET THE ORDER YOU ARE REQUESTING, BUT IT MAY CREATE MORE CONFLICT. YOU SHOULD TALK TO A CHILD CUSTODY ATTORNEY TO GET SOME BETTER IDEAS ON HOW TO DEAL WITH HIM. You will need to get a court order changing the visitation. It is unlikely that the court will order that visitation take place in your home. The usual option is to require supervised visitation. Supervisors for visitation charge about $150 per hour.

His failure to pay child support will not help much on the visitation issue. He refusal to take the parenting class is much more important. It can also be presented to the court to show that he does not intend to follow court orders.
