Legal Question in Family Law in California
Visitation
My son's father's girlfriend has threaten to kill me and my son, harassed me throughout my pregnancy (still harassing me) and has made sexual comments in reference to my son. She has said and done all this in front of my son's father. I have had 13 phone numbers because of her harassment. I finally just pulled myself and my son from this situation. I notifed the police because she informed me she was going to go to my son's daycare and blow my head off (she knows where he goes to daycare because my son's father give her all our information). I hae removed my son from this situation as well as myself. His father keeps e-mailing me in regards to seeing him but I do not feel it is safe. Am I breaking the law. I truly do fear for my safety as well as the safety of my son if left alone with his father. I do not want his father near us as his girlfriend has indicated she follows him and she knows where I live. I do not care who he is with but this girl is pyscho. She called me my whole pregnancy threatening me and telling me she was going to beat me up. Can I keep my son away from his father who condones her behavior and sees no wrong in it?

Re: Visitation
You should file for a DV restraining order against the woman and to limit visitation with father. Stopping visitation without petitioning the court for a change of visitation would be a violation of the court order and could cause you problems.
