Legal Question in Family Law in California
visitation and transportation
For the last yr. my ex picks up our children after school on Fri. and keeps them overnight. On Sat. nights we meet 1/2 way (a compromise) which means a 20 minute drive for me each way. After battling with him for the last two years he has finally run out of things to take me back to court, but is now hinting that since he picks up the kids on Fridays that I should drive out to his house (40 minutes each way)to pick them up every Saturday night. The problem I have with that is HE MOVED AWAY from the kids .. originally he was only 20 minutes away . We have 50/50 legal custody . I have 100% physical and he has 20% visitation. What is the typical pickup/dropoff arrangement?

Re: visitation and transportation
In answer to your questions, there is no normal rule or regulation regarding visitation. However, since the visitation is a right granted to your ex spouse, it would seem that if he wants to exercise that right it is up to him to make that effort to do so. Good luck.

Re: visitation and transportation
It would depend upon the county and the judge. In San Diego County generally the judge will order that the parent receiving the children pick them up. 40 minutes is not an extraordinary commute to pick up the children. Good Luck, Pat McCrary
