I have been divorced for 13 years and for 10 of the years my two children, now 18 and 16, lived with me, now they chose to move with thier mother.

We live about 200 miles away and the ability for me to visit and get a hotel for the night , has been cut drastically, due to my job loss.

I am not seeing it easy, but I am making my payments once a month.

She is threatning to take me back to court to force me to go down there more often, so she can have time for herself, I go approx. 1 day a month (usually Sunday)

When she paid support, she paid three hundred a month, so we agreed that I pay the same.

My income was cut by 1/3. I still plan on paying the same.I want too see them more often, but money is tight. I told her I would love to have them stay here they are more than welcome (in fact they have keys to home) and she wouldn't even have to pay support.

She threatened to take me to court

and force me to come down to visit them more often, I want to but as I said money is real tight and sometimes when I get work, my luck sometimes falls on the visit day.

What can she do ?

She can get a guideline child support order--which is primarily based on the amount of time you actually visit the kids, your income and her income.

She can file a motion to get a guideline support order which would almost certainly be greater than the $300 per month. I suggest that you get a consultation with an attorney who can calculate quideline support and you can make an education decision. Good Luck, Pat McCrary
