Legal Question in Family Law in California

Wage assignment order for child support

Was there a law passed in 1994 that made it MANDATORY a wage assignment order be included/placed in every case file where there was a support order? Is this true? And if so, and the obligor defaults in payment, how does obligee go about getting that order put into place? Would the clerk of Superior Court do this?(Local Child Support agency IS NOT involved with case, and I no longer have attorney)

Re: Wage assignment order for child support

A wage assignment form would have to be properly filled out and then issued by the court. After the order is issued by the court it must be served on his employer. You should consider having an attorney or child support services assist you in the collection of child support.
