Legal Question in Family Law in California

Wage assignment should be stopped

Thank you for taking my question. My daughter turned 18 years old this past April and graduated from high school in June. Her mother and I were never married and my daughter lives with her mother and now attends the community college part-time and working full-time. I earn over twice as much as her mother. The wage assignment Order states (probably as a standard) that the garnishment should continue until further notice. I do not owe any arrears and I am married with 4 very young children. How can I get the court to send to my employer a letter to stop the garnishment or what do I have to do to get it to stop and is it possible that I could be ordered to continue paying child support in this situation? Thank you.

Re: Wage assignment should be stopped

You will need to go to court to obtain an order stopping the wage assignment. You can also get an judgment for the overpayments that you have made. You are better off with an attorney, however, your local facilitators office may be able to assist you in preparing the motion. Good Luck, Pat McCrary
