Legal Question in Family Law in California

Waiting Perion and Benefits

Married for over 20 years

Are you required to be separated for 6 months prior to filing for a divorce in California?

Can a spouse maintain his/her spouses medical benefits once divorce? If so, for how long or are they responsible for getting COBRA through spouses plan?

Can a spouse be responsible for other spouses medical benefits after he/she retires if he/she will not receive medical coverage from current employment.

Re: Waiting Perion and Benefits

You do not need to wait to file your petition. In fact, you should file right away to obtain the protection of the automatice restraining orders. Based upon what you have told me you should sit down with an attorney to discuss the remaining issues. Much more information is needed to give a meaningful answer. Good Luck, Pat McCrary
