Legal Question in Family Law in California

I had a wedding 7 years ago, never did file the marriage certificate in California, does this make it a legal marriage. now we are seperated should I have to file for a divorce?

Unfortunately your marriage was never legalized. Since CA does not recognize common law marriage, you are legally a single person. However, that does not mean you do not have community property issue. The assets you accumulated with your partner are quasi marital property that are treated like community property. You should talk with a family law attorney since it can get very complicated in terms of pension, etc.
