Welfare Administrative Error

In 1989 my Husband was married to another woman. She was collecting welfare for a child she previously had. She did not report that she and my husband got married in 1989. In 2003 the county's overpayment recovery unit established the debt against my husband with the IRS with a delenqency date of 5/14/96. He or I was not aware of this action due to not receiving any notification. They intercepted our tax refund. Can the county hold him liable for her not reporting the information? Also, is there a Statue of limitations on this type of administration error as they call it?

Without reviewing the paper work involved in this case no one can respond. The amount of money involved would appear to be sufficient to justify the retention of an attorney to advise you as to whether there is any way to get relief. As a general rule he would not be responsible for her fraudulent obtaining of welfare assistance. However, there may be circumstances that would make him liable. You need to act quickly in this matter as any delay may prevent you from obtaining relief.
