Legal Question in Family Law in California

Welfare Fraud..

I'm a 20 years old and have been receiving cash aid for my first daughter for 2 years. When I applied for benefits I was not in contact with my baby's father, so I qualified under the ''absent parent'' rule, since then I have gotten in contact with him and have had a second daughter. I still live at home with my mother and I my babies' father is apart of our lives. He doesn't live in the home but he does visit often, I have given my case worker he updated information but not until my second child was born. Can I be considered a fraud case because I didn't give them information until now? What can I do, if I'm charged to prevent a felony conviction?

Re: Welfare Fraud..

It is probably not welfare fraud. Since the county can go back 3 years to obtain back support, it is unlikely that they would proceed against you. They will bring an action against the father for back support. Good Luck, Pat McCrary
