Legal Question in Family Law in California
My wife has gone crazy. She has lived in 3 states in the past 3 months. She is in currently in an unknown state with our 3 year old. I talked to her today, and she was bragging that our child has a new daddy and that I'll never know what state she is in.We have no custody order in place. I plan to file emergency temp. custody, but I don't know where she is. I can not afford an attorney. She has been a stay at home mom for the past year. She has been endangering our child, and sending me emails to prove it. She has threatened me. If the judge orders her back to CA, how do I prevent her from entering the home I am renting? We do not own any property. She doesn't want to live in CA. We have a prenup. She has an education and has always worked up until a year ago. Will I have to pay for her to live since she was a stay at home mom? Will I have to pay for an attorney for her?

You need to file a police report concerning this abduction and meet ASAP with an experienced family law attorney to explore your legal options.
You need to file for immediate custody of your child and for child abduction orders with a request that the D.A. help to return your child. And yes, you really do need to obtain and retain competent and experienced family law counsel. Good luck!
