Legal Question in Family Law in California

My wife and I are looking to get a divorce.we've been separated for three years now. We both have two kids together. Which they both stay with thier mother. Our daughter is 4 and son is 2 I rarely get to see my kids it's been a hassle jus to see them my daughter spends some weekends with me she is my sidekick my heart. Not yet since I've got to spend time with my son. It's a real hassle to get my kids without arguing n fighting with their mother. I want to know what are my rights and what can I do legally to have both my kids? What are the terms of a split custody of the children?

You are entitled to seek a court order giving you reasonable visitaton wih both children. Obviously, it would be better for all concerned if you can agree custody/visitation between you but if not, the court, providing there are no undeclared issues of unfitness, will make orders allowing reasonable and frequent visits with both children.

I strongly suggest that you retain the services of a good family law attorney to assist you.

When the divorce petition is filed, also file a motion to establish custody and visitation with your children.
